CONSTITUTION OF THE RB

CONSTITUTION OF THE RB, the basic law, which defines the public and state system, the order and principles of organization of state authorities, and the rights and duties of citizens. The decisions of AllBashkir Constituent Kurultay (December 8—20th, 1917) were of a constitutional significance. The Regulation on Autonomy of Malaya Bashkiriya developed by the Bashkir government in January 1918, acted as the Republic’s C. The Regulation on Autonomy of Malaya (thе Lesser) Bashkiriya proclaimed that Bashkortostan is part of Russia with its autonomous parliament. The 1925 C. of the BASSR, which included 93 Art., united in 8 chapters, was not approved by the Russian Central Executive Committee. Later, the Constitutions (Basic Law) of the Bashkir Autonomous Soviet Socialist Republic was adopted  in  1937  (approved  in  1940; included 114 articles) and 1978 (161 articles). The development of the Bashkortostan constitutional law was facilitated by the adoption of the Declaration on State Sovereignty of the BSSR and the Federal Treaty with the Annex from the RB. The basis of these documents were included in the Constitution (Basic Law) of the Re- public of Bashkortostan, adopted on the 12th session of the Supreme Council of the RB of the 12th convocation in Dec. 24th, 1993. The text of the current RB C. includes an Introductory Part, Two Sections and 126 Articles. The C. fixed the foundations of the republican constitutional system by establishing that the Republic of Bashkortostan is a democratic legal state in the RF, its equal subject. Relations between state authorities of the RB and state authorities of the RF are determined by the RB C., C. of the RF, Treaty of the RF and the RB On the Delimitation of the Subjects of Competence and Mutual Delegation of Powers between the Bodies of State Power of the Russian Federation and the Bodies of State Power of the Republic of Bashkortostan, and by other bilateral treaties and agreements. The status of the Republic and the boundaries of its territory can be changed only with the consent of the RB. The Bashkir and the Russian languages are recognized as official languages on the Republic’s territory (ref. Official language). The RB has its own state symbols. The division of state authority into legislative authority, executive authority and judicial authority is confirmed. Local Self‑Government is guaranteed. Ideological diversity, multiparty system and freedom of public activity are recognized. According to C., the RB is a social secular state, which preserves and protects historical and cultural heritage, develops culture of the Bashk. people and other peoples living in the Republic. State power in the Republic is exercised by the State Assembly—Kurultay of the RB, Head of the RB, the Government of the RB, local governments and courts. According to the low of the RB On the Procedure of Amendments and Additions to the Constitution of the Republic of Bashkortostan (April 28th, 2004) the C. may be amended. The changes were implemented in December 2002, June 2006, September 2008 July 2009, May 2011, June 2012, March 2014.
