CONVENTIONAL LAW

CONVENTIONAL LAW, a set of rules of conduct (customs), formed in a society as a result of their repeated application. The Bashkir applied the Law along with the Sharia until the beginning of the 20th century. The rules of the C.l. regulated all aspects of life of the Bashkir community, relations with the neighbouring tribes and peoples, intra- and extra‑tribal disputes. After accession of Bashkortostan to Russia the C.l. regulated distribution of yasak and troop supplies (ref. Military service of the Bashkirs). According to the shezhere and other sources, one of the Bashkirs’ conditions for accession to Russia was the recognition of their right to preserve their customs and religion, but after the Bashkir Uprisings of the 17–18th centuries, the All‑Bashkir yiyins were prohibited, senior representatives started to be elected. In the 18–19th centuries resolutions and juridical acts of the tsarist government, with reference to the Bashkirs and the Bashkir Army, permitted rural and volost assemblies, as well as canton leaders solve certain issues based on the C.l. Regulation on the Bashkirs of May 14th, 1863 legislatively recognized the Bashkir C.l. After the Revolution of 1917, following the codification of the Soviet Law and the legislation revision (1922–24), the scope of the C.l. was limited.
